Terms of Service

1. Acceptance

By creating an account or using LessAlarming (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms form a binding agreement between you and LessAlarming, LLC ("LessAlarming," "we," "us," or "our").

2. Description of Service

LessAlarming provides incident alerting and on-call management software delivered as a subscription service. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Accounts and Eligibility

You must be at least 18 years old and capable of entering a binding contract to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

4. Subscriptions and Payment

The Service is offered on a subscription basis. By subscribing, you authorize us to charge your payment method on a recurring basis at the applicable rate for your selected plan.

All fees are stated in US dollars and are exclusive of any taxes you may be required to pay. You are responsible for any applicable taxes.

Subscription fees are non-refundable except as expressly described in Section 5.

5. Refund Policy

We offer a 14-day free trial on all plans. No credit card is required to start a trial. If you subscribe and are dissatisfied for any reason within the first 30 days of a paid subscription, contact us at [email protected] and we will issue a full refund of your most recent charge.

After 30 days, all charges are final and no refunds will be issued except where required by applicable law.

6. Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to the Service through the end of the period for which you have already paid.

7. Acceptable Use

You agree not to use the Service for any unlawful purpose, to transmit harmful or malicious content, to attempt to gain unauthorized access to any system, or in any way that could damage or impair the Service or other users' experience.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LESSALARMING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which LessAlarming, LLC is incorporated, without regard to conflict of law principles.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice in the Service. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
